There is no fundamental mystery in this matter of conflict over control of property.  There are quite actually a very limited number of ways in which a conflict can be resolved.

Take for example in which an honest dispute arises between two men who own land adjacent to one another.

For one reason or another through no fault or intent of either of them, the boundary between their respective holdings has been improperly described and defined.
